1. About BreakSilence
BreakSilence ("we," "us," or "our") is a consumer advocacy platform that helps individuals document and communicate complaints to businesses and regulatory bodies. We use AI to help users articulate their experiences and, where purchased, dispatch formal correspondence on their behalf. We are a neutral conduit. We do not verify the accuracy of complaints submitted, take sides in disputes, or guarantee any response from recipients.
2. Eligibility
You must be at least 18 years old and a resident of the United States to use this service. By submitting a complaint, you represent that you are describing a real experience that occurred and that you have the right to submit this information.
3. User Responsibilities & Accuracy
You are solely responsible for the accuracy of information you provide. By submitting a complaint, you confirm that: • The incident described is truthful and based on your genuine experience. • You are not fabricating, exaggerating, or knowingly including false information. • Your complaint is directed at the correct business or individual. Submitting false, defamatory, or harassing content is strictly prohibited and may result in account termination and potential legal liability. BreakSilence reserves the right to decline or cancel any submission at its discretion. BreakSilence utilizes AI to draft correspondence based on your input. You are solely responsible for reviewing the full text of any generated letter before authorizing dispatch. By clicking to send or dispatch, you confirm that the AI-generated content accurately reflects your intent and experience, and you accept full responsibility for its contents.
4. Paid Services & Payments
BreakSilence offers the following paid dispatch services: • Email Dispatch — $1.99 per complaint: We send a formatted complaint email on your behalf to the identified corporate or regulatory recipient. • Physical Letter (USPS First-Class Mail) — $2.99 per complaint: We print and mail a physical letter via USPS First-Class Mail to the corporate address on record. All payments are processed securely by Stripe. By completing a purchase, you authorize the charge to your payment method. All prices are in USD and inclusive of applicable processing fees.
5. Refund Policy
Because our paid services involve the immediate preparation and delivery of correspondence, all sales are final once dispatch has been confirmed. If a technical error on our end prevents delivery, we will either re-attempt delivery or issue a full refund at our discretion. To report a delivery issue, contact us at support@breaksilence.io within 7 days of purchase. Refunds will not be issued because a business did not respond, or because you changed your mind after dispatch.
6. Disclaimer of Warranties
BreakSilence makes no warranties, express or implied, regarding: • The outcome of any complaint or correspondence dispatched through our platform. • The accuracy of corporate contact information sourced or inferred by our AI. • The delivery or response rate of physical or digital correspondence. The service is provided "as is" and "as available" without warranty of any kind.
7. Limitation of Liability
To the fullest extent permitted by law, BreakSilence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of business, reputation, or data. Our total liability to you for any claim shall not exceed the amount you paid for the specific transaction giving rise to the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless BreakSilence and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the service; or (c) any complaint, content, or correspondence you submit or dispatch through our platform, including any claim by a third party that your submitted content is false, defamatory, or otherwise unlawful.
9. Prohibited Uses
You may not use BreakSilence to: • Submit complaints that are false, defamatory, harassing, or intended to harm an individual or business without basis. • Target private individuals who are not acting in a business capacity. • Violate any applicable law, including anti-spam laws (CAN-SPAM, GDPR). • Attempt to reverse-engineer, scrape, or abuse the platform's infrastructure.
10. Intellectual Property
All AI-generated content produced by BreakSilence on your behalf is provided for your personal, non-commercial use in connection with your complaint. You may not resell or redistribute generated letters or templates.
11. Dispute Resolution & Class Action Waiver
Any dispute or claim relating to your use of BreakSilence will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court, except that you may assert claims in small claims court if your claim qualifies. YOU AND BREAKSILENCE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION. All claims must be brought individually, not as part of a class or representative proceeding. The arbitration will be conducted in California and governed by the laws of the State of California.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page will always reflect the most recent version.
